1.0 TERMS AND CONDITIONS
Effective 1 July 2025
These terms and conditions apply where you pay your allocated Cleaner directly.
TERMS
If the customer (you) receives a "Confirmation of your Cleaning Services" from Botanica Clean Pty Ltd ACN 656 248 690 (Botanica Clean), after submitting a customer registration form and booking request (Booking Request) these terms and conditions (Terms) will form an agreement between you and your allocated cleaner (Cleaner/I/me). By proceeding with your Booking Request you confirm that you agree with these Terms.
Cleaning Services
I agree to provide you with in-home cleaning services in accordance with these Terms and any Booking Request that you have (Cleaning Services).
I offer three types of Cleaning Services:
1. Regular Clean: The minimum booking time for a regular clean is 2 hours, however I typically recommend booking for 3 hour in duration. It is usually booked on a weekly or fortnightly basis. A regular clean will include cleaning surfaces around the home (including kitchen and bathroom counters), dusting furniture, cleaning toilets, and vacuuming and mopping interior floors. It may also include additional cleaning, if time permits, depending on the size of the home;
2. Once-off Clean: The minimum booking time for a once-off clean is 3 hours. Typically I recommend you book for between 3 - 6 hours in duration. This type of Cleaning Service includes all of the same services as a regular clean but is charged at a higher rate; and
3. Detailed seasonal cleaning: The minimum booking time for a detailed seasonal clean is 3 hours. Typically I recommend you book for between 4 - 8 hours in duration. This Cleaning Service is usually booked once every three months. It includes the same services as a regular clean, plus cleaning windows and a comprehensive bathroom and kitchen clean (including inside the oven and microwave). It may also include additional cleaning, if time permits.
The above Cleaning Services are intended as a guide only and the Cleaning Services provided for each type of clean above may vary, depending on the home, and the duration of the Cleaning Services. I will use my best efforts to perform as many items in the Cleaning Service as I can in the time you have booked.
If there is a particular area of your home that you would like me to focus on, please let me know.
I offer domestic Cleaning Services only. Please notify Botanica Clean in your Booking Request if you require a service other than domestic Cleaning Services, as these are not services typically offered. Botanica Clean will assess whether they are able to provide a cleaner to perform the required cleaning services on a case by case basis.
Booking with Botanica Clean
To book Cleaning Services with me, you must complete the Booking Request on the Botanica Clean website, which includes a customer registration form. You will be required to provide certain personal information, including your contact details, your home address, your cleaning requirements and preferences.
By submitting a Booking Request, you agree to Botanica Clean sharing your personal information with me for the purpose of performing the Cleaning Services.
You must ensure that all information provided to Botanica Clean (whether via the website, or otherwise), is true and correct . You must not provide me or them with the address, contact details or payment details of a third party without the third-party's written consent.
All Booking Requests are subject to availability and Botanica Clean may refuse Booking Requests for any reason. If Botanica Clean accepts your Booking Request, they will notify you in writing (Confirmation) and provide your contact details to me to arrange a time directly with You for the Cleaning Services to take place.
Botanica Clean receive and review National Police Checks for all cleaners prior to providing a clients details to any cleaner.
You acknowledge that I will contact you from my own personal mobile phone and you must:
1. not contact me for any purpose other than arranging a time for Cleaning Services; and
2. always communicate with me in a professional and courteous manner, respect my privacy and only call or text you on my personal mobile phones during normal business hours.
If you have a complaint about me or the Cleaning Services provided, you must contact Botanica Clean directly in accordance with the complaint procedure below.
Cleaning products and equipment
I will provide and use Botanica Clean's own natural cleaning products and am prohibited from using alternate cleaning products when performing the Cleaning Services.
I will be equipped with all equipment required for the Cleaning Services. However, if you would like the Cleaning Services to be performed using your own cleaning equipment (such as your own mop or vacuum), please let me know and I will use your preferred cleaning equipment during the Cleaning Services, provided the equipment is safe, easily accessible to me, and in good working order.
If you me to use your own cleaning equipment I will not be liable for:
1. any damage or wear and tear to that equipment; and
2. and will not give you a refund of any portion of the cleaning fees, if I am unable to perform the Cleaning Services properly because the equipment you provided is not safe, accessible or in good working order,
except to the extent that I caused or contributed to any damage.
Pricing and payment terms
Cleaning Services are charged on an hourly rate basis. Your Confirmation details the price (Price) of the Cleaning Services with me. The applicable hourly rates for each type of clean are also published on the Botanica Clean website (www.botanicaclean.com.au). Prices may change from time to time and Botanica Clean will notify you in writing of any change to Price by giving 30 days to You. You may terminate your Cleaning Services if you do not want to continue based on the new Price. You will be required to pay me directly for the Cleaning Services.
You must pay for the Cleaning Services via cash, merchant payment (i.e. square or stripe) or bank transfer into the bank account nominated by me.
I reserve the right to cancel your Cleaning Services if you have not paid prior to the date your Cleaning Service is scheduled to occur.
If you have paid the Price prior to the date of the Cleaning Services, and I am unable or unwilling to perform the Cleaning Services for any reason, I will provide you with a full refund of the Price.
The Price, unless otherwise specified, is inclusive of GST.
If you fail to pay me for the Cleaning Services, Botanica Clean may after a period of two (2) weeks recover payment you owe to me on my behalf. If a debt collection company or legal services are required to recover the debt, these will be costs that you may be required to reimburse Botanica Clean for.
Cleaner responsibilities
I will :
1. provide the Cleaning Services in a professional manner with due care and skill, and at the agreed time and location; and
2. be appropriately trained and equipped with all necessary cleaning products and equipment.
Your responsibilities
You must:
1. treat me with respect at all times and not engage in any conduct that could make me feel uncomfortable or unsafe;
2. provide me with all information reasonably needed in order to provide you with the Cleaning Services in a safe and efficient manner, this includes, for example if someone other than you will be at the home to make payment and grant access;
3. advise us in advance if there will be any pets present at the time of providing the Cleaning Services and ensure those pets are restrained for the duration of the Cleaning Services;
4. provide me with a safe working environment, and sufficient access to your home and utilities (including hot and cold water, electricity, and rubbish bins) to enable me to perform the Cleaning Services;
5. not leave obstructions in the areas of your home that require Cleaning Services, or ask me to move or dispose of any furniture, heavy items or hazardous materials;
6. securely stow away any important documents, antiques, valuables or fragile items for the duration of the Cleaning Services;
7. maintain adequate insurance for your home including public liability insurance;
8. maintain and adequate household workers' insurance policy to cover potential compensation costs if I am injured while working at your home; and
9. maintain adequate supervision and oversight of your home during the Cleaning Services.
I am not liable to you for any delays, damage or loss you suffer as a result of your failure to comply with the above responsibilities. You agree to indemnify ,and hold me harmless against, any loss or damage suffered or incurred by me as a result of your failure to comply with the above, to the extent that it was not caused or contributed to by me. For clarity, this includes paying any costs incurred by me where any pet that has not been supervised or restrained causes illness or injury to me.
It is recommend that you are always present when the Cleaning Services are taking place at your home.
If you choose to lend me a key to your home because you will not be present at the time of a scheduled clean, you do so at your own risk.
Cancellation and no access fees
If you need to cancel or change your Booking Request, please provide me with as much notice as possible so that I can make alternative arrangements.
If you cancel less than 24 hours in advance of a scheduled clean, or if I arrive at your home at the scheduled time and am unable to access the home, I reserve the right to charge you an administrative fee of $100 (including GST), which you must pay within 7 days of the cancelled clean.
Confidentiality and privacy
I agree to keep the personal information you provide to either me or Botanica Clean concerning your home and Cleaning Services confidential. This information will only be used for the purposes of providing you with Cleaning Services or performing obligations and exercising rights under these Terms.
You agree to keep the information either Botanica Clean or I provide to you concerning the me (including my bank details) confidential, and not to use or disclose the information for any purpose other than performing your obligations and exercising your rights under these Terms.
Complaints
If you are dissatisfied with the Cleaning Services provided, please let Botanica Clean know within two (2) business days after completion of the Cleaning Services. You can make a complaint by contacting them via email on bookings@botanicaclean.com.au.Botanica Clean takes all complaints seriously and will respond to you promptly.
Suspension and termination
You may notify me in writing (including via text) at any time if you no longer require the Cleaning Services. I am not entitled to charge an administrative fee, if a scheduled clean is cancelled with less than 24 hours' notice.
I may terminate this agreement, or suspend the provision of Cleaning Services to you, at any time by providing you with prior reasonable notice in writing. If I cancel a booking that you have paid for in advance, I will provide you with a full refund for that booking.
Liability
I exclude, to the fullest extent permitted by law, all warranties, representations and conditions whether implied by law, trade, custom or otherwise.
If the Australian Consumer Law applies to the Cleaning Services, my liability to you for any loss that you suffer or incur relating to my failure to comply with any consumer guarantee set out in the Australian Consumer Law is limited to (at my election):
1. the re-supply of the services; or
2. the payment of the cost of having the services supplied again.
My liability for any loss or damage, suffered by you in connection with this agreement is limited to an amount equal to the price you paid to me for the relevant Cleaning Services, or $100 (whichever is greater). This clause does not apply to the extent that it would cause us to contravene a law or cause the clause to be void or unenforceable.
Changes to these Terms
I reserve the right to update or modify these Terms from time to time. I will provide you with 30 days' notice in writing when I change the Terms including details of when the terms will change.
Severability
You agree that if any part of these Terms is invalid, void or unenforceable, then that part will be considered severable and the remaining Terms shall continue to bind the parties.
Law and jurisdiction
This agreement shall be governed by the laws of Queensland. Each party submits to the non-exclusive jurisdiction of the courts of Queensland in the event of any dispute.
These Terms apply from 1 July 2025.
2.0 TERMS AND CONDITIONS

These terms and conditions only apply if we engage the Cleaner and you pay us directly. If we refer you to one of our Cleaners and you enter into an agreement with them and pay them directly, their terms and conditions (see 1.0) will apply to the Cleaning Services.
TERMS

Our Cleaning Services

The above Cleaning Services are intended as a guide only and the Cleaning Services provided for each type of clean above may vary, depending on the home, and the duration of the Cleaning Services. The Cleaner will use their best efforts to perform as many items in the Cleaning Service as they can in the time you have booked.
If there is a particular area of your home that you would like us to focus on, please let us know via email or contact your Cleaner directly. We will use our best efforts to accommodate your request within the time provided.
We offer domestic Cleaning Services only. Please notify us in your Booking Request if you require a service other than domestic Cleaning Services, as these are not services we typically offer. We will assess whether we can perform the required cleaning services on a case by case basis and provide you with confirmation as to whether we can perform the cleaning services you require.
Booking with Botanica Clean
To book Cleaning Services with us, you must complete the Booking Request on our website, which includes a customer registration form. You will be required to provide us with certain personal information, including your contact details, your home address, your cleaning requirements and preferences.
By submitting a Booking Request, you agree to us sharing your personal information with your allocated Cleaner (Cleaner) for the purpose of performing the Cleaning Services.
You must ensure that all information provided to us (whether via our website, or otherwise), is true and correct . You must not provide us with the address, contact details or payment details of a third party without the third-party's written consent.
All Booking Requests are subject to availability and we reserve the right to refuse Booking Requests for any reason. If we accept your Booking Request, we will notify you in writing (Confirmation) and provide your contact details to the Cleaner to arrange a time directly with You for the Cleaning Services to take place.
Botanica Clean receive and review National Police Checks for all cleaners prior to providing a clients details to any cleaner.
You acknowledge that our Cleaner will contact you from their own personal mobile phone and you must:
1. not contact our Cleaners for any purpose other than arranging a time for Cleaning Services; and
2. always communicate with our Cleaners in a professional and courteous manner, respect each Cleaner's privacy and only call or text our Cleaners on their personal mobile phones during normal business hours.
If you have a complaint about a Cleaner or the Cleaning Services, you must contact Botanica Clean directly in accordance with the complaint procedure below.
We like to facilitate work for our Cleaners for periods of more than 2 hours, and in some cases, we may be required by law to do so. Please refer to the minimum duration allocated to each Cleaning Service described above.
If you would like a shorter clean, please let us know in your Booking Request and we will use our best efforts to accommodate your request. If we are able to accommodate your request, we will notify you in our Confirmation.
Cleaning products and equipment
Using our own natural cleaning products is important to us, and for the safety of our Cleaners. For this reason, we do not allow our Cleaners to use other cleaning products when performing the Cleaning Services.
The Cleaner will be equipped with all equipment required for the Cleaning Services. However, if you would like the Cleaning Services to be performed using your own cleaning equipment (such as your own mop or vacuum), please let us know in your Booking Request. The Cleaner will use your preferred cleaning equipment during the Cleaning Services, provided the equipment is safe, easily accessible to the Cleaner, and in good working order.
If you ask us to use your own cleaning equipment we are not liable for:
1. any damage or wear and tear to that equipment; and
2. and will not give you a refund of any portion of the cleaning fees, if we are unable to perform the Cleaning Services properly because the equipment you provided is not safe, accessible or in good working order,
except to the extent that we or the Cleaner caused or contributed to any damage.
Pricing and payment terms
Our Cleaning Services are charged on an hourly rate basis. Our Confirmation details the price (Price) of the Cleaning Services with the Cleaner. Our Price may change from time to time and we will notify you in writing of any change to Price by giving 30 days to You. You may terminate your Cleaning Services if you do not want to continue based on the new Price.
Regular Clean Payment
We will issue an invoice to you directly after your regular Cleaning Service has been completed.
You are required to pay the invoice Price within 7 days of the regular Cleaning Service occurring via:
1. Square which accepts Apple Pay, credit card and debit card; or
2. direct debit.
Please note that payment via Square will incur a 2.2% surcharge. This surcharge will be reflected in your invoice.
If you would like to pay for your Cleaning Services via direct debit, please advise us in your Booking Request.
You may change your payment method at any time by notifying us in writing. We are able to accommodate any change if we are notified 24 hours prior to your Cleaning Services. If notice is provided within 24 hours of your Cleaning Services occurring, the change will become effective on the following invoice.
Once off and Seasonal Clean Payment
If you have booked a seasonal or a once off clean, you must pay the Price in full, prior to the commencement of your Cleaning Services.
We will issue you an invoice 7 days prior to the scheduled time of your Cleaning Services. Your invoice must be paid via:
1. bank transfer into our nominated bank account which will be notified to you in the invoice; or
2. credit card.
We reserve the right to cancel your Cleaning Services if you have not paid prior to the date your Cleaning Service is scheduled to occur.
If you have paid the Price prior to the date of the Cleaning Services, and we are unable or unwilling to perform the Cleaning Services for any reason, we will provide you with a full refund of the Price.
The Price, unless otherwise specified, is inclusive of GST.
If a debt collection company or legal services are required to recover the debt, these will be costs that you may be required to reimburse Botanica Clean for.
Our responsibilities
We agree to:
1. provide a Cleaner to provide the Cleaning Services in a professional manner with due care and skill, and at the agreed time and location; and
2. ensure our Cleaner who is providing you with the Cleaning Services is appropriately trained and equipped with all necessary cleaning products and equipment.
Your responsibilities
You must:
1. treat the Cleaner with respect at all times and not engage in any conduct that could make the Cleaner feel uncomfortable or unsafe;
2. provide us with all information we reasonably need in order to provide you with the Cleaning Services in a safe and efficient manner, this includes, for example if someone other than you will be at the home to make payment and grant access to the Cleaner;
3. advise us in advance if there will be any pets present at the time of providing the Cleaning Services and ensure those pets are supervised or restrained for the duration of the Cleaning Services;

We are not liable to you for any delays, damage or loss you suffer as a result of your failure to comply with the above responsibilities unless we caused or contributed to such delay, damage or loss.
You agree to indemnify ,and hold us harmless against, any loss or damage suffered or incurred by us as a result of your failure to comply with the above, to the extent that it was not caused or contributed to by us. For clarity, this includes paying any costs incurred by us or the Cleaner where any pet that has not been supervised or restrained causes illness or injury to the Cleaner.
We recommend that you are always present when the Cleaner is providing Cleaning Services at your home.
If you choose to lend the Cleaner a key to your home because you will not be present at the time of a scheduled clean, you do so at your own risk. Botanica Clean is not responsible for the cost of replacing lost or damaged keys.
Cancellation and no access fees
If you need to cancel or change your Booking Request, please provide us with as much notice as possible so that we can make alternative arrangements for the Cleaner.
If you cancel less than 24 hours in advance of a scheduled clean, or if the Cleaner arrives at your home at the scheduled time and is unable to access the home, we reserve the right to charge you an administrative fee of $100 (including GST), which you must pay within 7 days of receiving an invoice from us.
Confidentiality and privacy
We agree to keep the personal information you provide to us concerning your home and Cleaning Services confidential. We will only use this information for the purposes of providing you with Cleaning Services or performing our obligations and exercising our rights under these Terms.
You agree to keep the information we provide to you concerning the Cleaner confidential, and not to use or disclose the information for any purpose other than performing your obligations and exercising your rights under these Terms.
Complaints
If you are dissatisfied with the Cleaning Services provided, please let us know within two (2) business days after completion of the Cleaning Services. You can make a complaint by contacting us via email on bookings@botanicaclean.com.au.
You must provide photographs with any complaint. We cannot guarantee that we will be able to progress your complaint without the provision of photographs.
We take all complaints seriously and will respond to you promptly.

You may notify us in writing at any time if you no longer require the Cleaner to provide the Cleaning Services. Note, however, that we may charge an administrative fee, if a scheduled clean is cancelled with less than 24 hours' notice.
We may terminate this agreement, or suspend the provision of Cleaning Services to you, at any time by providing you with prior reasonable notice in writing. If we cancel a booking that you have paid for in advance, we will provide you with a full refund for that booking.
Liability

No engagement of Cleaners
You must not, during the period you engage Botanica Clean to provide Cleaning Services and for 6 months after our last Cleaning Service, engage, employ, solicit or otherwise retain any person who is a Cleaner or sub-contractor of Botanica Clean other than where we have referred a Cleaner to you who pays a referral fee to Botanica Clean in which case you may engage them directly.
Breaches of this clause may result in Botanica Clean suffering financial loss, including costs associated with the recruitment and training of replacement Cleaners. You agree that the restrictions in this clause are necessary to protect the legitimate interests of Botanica Clean.
Changes to these Terms
Botanica Clean reserves the right to update or modify these Terms from time to time. We will provide you with 30 days' notice in writing when we change the Terms including details of when the terms will change.
Severability
You agree that if any part of these Terms is invalid, void or unenforceable, then that part will be considered severable and the remaining Terms shall continue to bind the parties.

Please take some time to read these terms and conditions. We want you to feel comfortable, knowing you are receiving the right cleaning services for your home.
These terms take effect from 1 January 2022, and form an agreement between Botanica Clean Pty Ltd ACN 656 248 690 (Botanica Clean, we, us) and the customer ordering our services (you). By booking cleaning services with us after we provide you with these terms and conditions, or by clicking 'I accept' when registering as a new customer on our website (www.botanicaclean.com.au), you confirm that you accept these terms and conditions, and agree to comply with them.
About Botanica Clean
We believe that the home is the foundation of your, and your family’s, health. For this reason, our services are performed using all natural cleaning products, made in-house by Botanica Clean. Our products contain all natural ingredients, such as vinegar, which is a natural disinfectant.
If you are looking for a COVID deep clean, a commercial premises clean, cleaning of a hoarding situation or a bond clean, please let us know before booking, as this is probably not the right service for you.
Our Cleaning Services
We agree to provide you with in-home cleaning services in accordance with this agreement and any confirmed booking that you have with us (Cleaning Services).
All of our Cleaning Services are charged on an hourly rate basis, and you will generally need to pay for the total hours you have booked in advance of the clean. The cleaning services that are able to be provided within the allocated time you have booked will vary depending on the size of your home. As a guide, below is a high-level description of the three types of cleans we currently offer:
Regular clean: A regular clean is typically 3 hours in duration, and is usually booked on a weekly or fortnightly basis. A regular clean will include cleaning surfaces around the home (including kitchen and bathroom counters), dusting furniture, cleaning toilets, and vacuuming and mopping interior floors. It may also include additional cleaning services, if time permits, depending on the size of the home;
Once-off cleaning. A once-off clean is typically between 3 - 6 was hours in duration, and includes all of the same services as a regular clean. We charge slightly more for a once-off clean, because there is typically more work involved for our cleaners in cleaning a home that does not have regular weekly or fortnightly cleans; and
Detailed seasonal cleaning. A detailed seasonal clean is typically 4 - 8 hours in duration, and is usually booked once every three months. It includes all of the same services as a regular clean, plus cleaning windows and a comprehensive bathroom and kitchen clean (including inside the oven and Microwave). It may also include additional cleaning services, if time permits, depending on the size of the home.
The services provided for each type of clean above will vary slightly, depending on the home, and the duration of time booked for the clean. The cleaner will use their best efforts to perform as many Cleaning Services as they can in the time you have booked. If there is a particular area of your home that you would like us to focus on, please let us know when making the booking. We will use our best efforts to accommodate your requests within the time provided.
Booking with Botanica Clean
To book Cleaning Services with us, you must complete the customer registration form on our website and provide us with certain information, such as your contact details, the address of your home, and your cleaning requirements and preferences.
You agree to ensure that all of the information you provide to us (whether on our website, or otherwise), is true, correct and submitted in good faith. You must not provide us with the address, contact details or payment details of a third party, unless you have that person's consent to do so.
All booking requests are subject to availability and we reserve the right to refuse booking requests for any reason.
Once we have confirmed your booking in writing, we will provide your contact details to the allocated cleaner to arrange a mutually convenient time for the Cleaning Services to take place. You acknowledge that our cleaners will contact you from their own personal mobile phone and you agree to:
not contact our cleaners for any purpose other than arranging times for scheduled cleans; and
always communicate with our cleaners in a professional and courteous manner, respect each cleaner's privacy and only call or text our cleaners on their personal mobile phones during normal business hours.
We like to provide our cleaners with shifts of at least three hours, and in some cases, for casual cleaners, we may be required by law to do so. For this reason, we ask that you book a clean of at least three hours. If you would like a shorter clean, please let us know and we will use our best efforts to accommodate your request.
Cleaning products and equipment
Using our own natural cleaning products is important to us, and the safety of our cleaners. For this reason, we do not allow our cleaners to use other cleaning products when performing the Cleaning Services.
If you would like the Cleaning Services to be performed using your own mop or vacuum, please let us know. We would be happy to use your preferred cleaning equipment, provided the equipment is safe, easily accessible to the cleaner, and in good working order.
If you ask us to use your own cleaning equipment (mop or vacuum):
we are not liable for any damage or wear and tear to that equipment; and
we are not liable for, and will not give you a refund of any portion of the cleaning fees, if we are unable to perform the Cleaning Services properly because the equipment you provided is not safe, accessible or in good working order.
Pricing and payment terms
Our Cleaning Services are charged on an hourly rate basis. The applicable hourly rates for each type of clean are published on our website (www.botanicaclean.com.au).
Unless we have agreed a different arrangement with you in writing prior to the scheduled date of your clean, you must pay for the Cleaning Services you book in full:
in advance of the scheduled clean, by bank transfer or credit card; or
within 7 days of receiving a tax invoice from us.
If you are not going to be home at the time of your scheduled clean, you must let us know and arrange payment in advance of your scheduled clean. We reserve the right not to perform the Cleaning Services if you have not paid for the clean in advance and are not home to make payment when the cleaner arrives.
If you have paid in advance for a clean, and we are unable or unwilling to perform the Cleaning Services for any reason, we will provide you with a full refund.
All prices quoted, unless otherwise specified, are inclusive of GST. Tax invoices are available, upon request.
Our responsibilities
We agree to:
provide the Cleaning Services in a professional manner with due care and skill, and at the agreed time and location; and
ensure all of our cleaners involved in providing you with the Cleaning Services are appropriately trained and equipped with all necessary cleaning products and equipment.
Your responsibilities
You must:
treat our clearers with respect at all times and not engage in any conduct that could make our cleaners feel uncomfortable or unsafe;
provide us with all of the information that we reasonably need in order to provide you with the Cleaning Services in a safe and efficient manner, including, for example:
if someone other than you will be at the home to make payment and let the cleaner in; and
if there will be any pets present at the time of the clean;
provide our cleaners with a safe working environment, and sufficient access to your home and utilities (including hot and cold water, electricity, and rubbish bins) to enable the cleaner to perform the Cleaning Services;
not leave obstructions in the areas of your home that require Cleaning Services, or ask our cleaners to move or dispose of any furniture, heavy items or hazardous materials; and
securely stow away any important documents, antiques, valuables or fragile items for the duration of the Cleaning Services.
We are not liable to you for any delays, damage or loss you suffer as a result of your failure to comply with the above responsibilities and you agree to indemnify us in relation to any loss or damage that we suffer (including third party claims against us) that arise as a result of your failure to comply with clause 7.1.
We recommend that you are always present when our cleaners are providing Cleaning Services at your home.
If you choose to lend a cleaner a key to your home because you will not be present at the time of a scheduled clean, you do so at your own risk. Botanica Clean is not responsible for the cost of replacing lost or damaged keys.
It is your responsibility to maintain adequate insurance for your home.
Cancellation and no access fees
If you need to cancel or change your booking, please provide us with as much notice as possible so that we can make alternative arrangements for our cleaners.
If you cancel less than 24 hours in advance of a scheduled clean, or if our cleaner arrives at your home at the scheduled time is unable to access the home, we reserve the right to charge you an administrative fee of $100 (including GST), which you must pay within 7 days of receiving an invoice from us.
COVID-19 vaccination policy
We do not currently have a mandatory vaccination policy at Botanica Clean and accordingly, some of our cleaners may be unvaccinated against COVID-19.
If you would like to request that only cleaners that are fully vaccinated against COVID-19 attend your home, you must notify us when you make your booking.
Please do not ask our cleaners for information concerning their vaccination status (or any other personal information). If you have any questions or concerns regarding our Cleaning Services or cleaners, please contact Botanica Clean on (07) 2139 3770 or bookings@botanicaclean.com.au.
Confidentiality and privacy
We agree to keep the information you provide to us concerning your home and cleaning needs confidential. We will only use this information for the purposes of providing you with services, or performing our obligations and exercising our rights under this agreement.
You agree to keep the information we provide to you concerning our cleaners confidential, and not to use or disclose the information for any purpose other than performing your obligations and exercising your rights under this agreement.
Complaints
If you are dissatisfied with the Cleaning Services provided, please let us know within 24 hours of completion of the Cleaning Services by contacting us by email on bookings@botanicaclean.com.au.
We take all complaints seriously and will respond to you promptly.
Suspension and termination
You may notify us at any time that you no longer wish to purchase Cleaning Services from us. Note, however, that we may charge an administrative fee in accordance with clause 8, if a scheduled clean is cancelled with less than 24 hours' notice.
We may terminate this agreement, or suspend the provision of Cleaning Services to you, at any time by providing you with notice in writing. If we cancel a booking that you have paid for in advance, we will provide you with a full refund for that booking.
Liability
We exclude, to the fullest extent permitted by law, all warranties, representations and conditions whether implied by law, trade, custom or otherwise.
If the Australian Consumer Law applies to the Cleaning Services, our liability to you for any loss that you suffer or incur relating to our failure to comply with any consumer guarantee set out in the Australian Consumer Law is limited to (at our election):
the re-supply of the services; or
the payment of the cost of having the services supplied again.
The liability of Botanica Clean for any loss or damage, howsoever arising (including negligence) suffered by you in connection with this agreement is limited to an amount equal to the price you paid to us for the relevant Cleaning Services, or $100 (whichever is greater). This clauses 13.3 does not apply to the extent that it would cause us to contravene a law or cause the clause to be void or unenforceable.
No engagement of cleaners
We have invested significant time, effort and resources in recruiting and training our cleaners. For this reason, retaining our cleaners is important to us. You must not, during the period we are engaged to provide Cleaning Services for you and for 6 months after our last Cleaning Service for you, directly or indirectly engage, employ, solicit or otherwise retain any person who is an employee or subcontractor of Botanica Clean.
Breaches of this clause may result in Botanica Clean suffering financial loss, including costs associates with the recruitment and training of replacement cleaners. You agree that the restrictions in this clause 14 are necessary to protect the legitimate interests of Botanica Clean.
Changes to these terms and conditions
Botanica Clean reserves the right to update or modify these terms and conditions from time to time. We will publish the updated terms and conditions on our website, with the effective date of the update shown. Please check our website regularly to keep abreast of any changes.
Severability
You agree that is any part of this agreement is held invalid, void or unenforceable, then that part will be considered severable and the remaining terms of in this agreement shall continue to be binding.
Law and jurisdiction
This agreement shall be governed by the laws of Queensland. Each party submits to the non-exclusive jurisdiction of the courts of Queensland in the event of any dispute.
